TERMS OF SERVICE

1. Acceptance of Terms

By accessing LaunchGround, you agree to these Terms of Service and confirm that you are at least 18 years old and have the legal capacity to enter a binding agreement under Kenyan law. If you do not agree, do not use the platform.

2. Description of Service

LaunchGround is Kenya's innovation platform for showcasing launches and community feedback. The platform includes Breaking Ground (launch posts), Ground Check (discussion threads), and High Ground (leaderboards and discovery).

3. User Accounts

You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity under your account and may maintain only one account per person unless we approve otherwise.

4. User Obligations

You agree to use LaunchGround lawfully, respect other users, and comply with Kenyan law, including the National Cohesion and Integration Act and the Computer Misuse and Cybercrimes Act. You must not misuse the platform to harass, deceive, or harm others.

5. Content Guidelines

LaunchGround offers Roast and Toast modes to shape community feedback. Roast mode allows direct, critical feedback; Toast mode focuses on constructive encouragement. In all cases, roast ideas, not people.

Prohibited content includes hate speech, doxxing, scams, malware, or misleading claims. We may remove content that violates these standards or Kenyan law.

6. User-Generated Content and Platform Liability

You are solely responsible for the content you submit. LaunchGround does not pre-screen or endorse user submissions and may remove content that violates these Terms. Kenya does not provide a safe harbour for intermediaries, so we may be required to act on lawful takedown requests. Report violations to [email protected], and we will respond promptly.

7. Intellectual Property

You retain ownership of your content and grant LaunchGround a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content on the platform.

8. Third-Party Services

LaunchGround integrates with third-party services such as Polar.sh for payments and OAuth providers for login. Your use of those services is governed by their respective terms.

9. Payment Terms

Polar.sh is the merchant of record for paid subscriptions. Pricing, billing, and refund eligibility are handled by Polar.sh policies, and refunds are considered on a case-by-case basis within their dispute process.

10. Disclaimer of Warranties

LaunchGround is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.

11. Limitation of Liability

To the maximum extent permitted by law, LaunchGround is not liable for indirect, incidental, or consequential damages. This limitation does not exclude liability for fraud, wilful misconduct, or gross negligence.

12. Indemnification

You agree to indemnify and hold LaunchGround harmless from claims arising out of your content or misuse of the platform.

13. Termination

We may suspend or terminate accounts that violate these Terms. To request account deletion, contact [email protected].

14. Changes

We will provide at least 30 days' notice for material changes to these Terms. Continued use after changes take effect constitutes acceptance.

15. Governing Law and Jurisdiction

These Terms are governed by the laws of Kenya, and any disputes must be resolved exclusively in the courts of Nairobi.
